Hours of Operation - Sunday Sales – Ward 3 - Location Regulations - Possession of Dangerous Weapons on Licensed Premises

Hours of Operation:
It shall be unlawful for any person, firm or corporation holding a Class A retail dealer permit (on-premises consumption) or a Class B retail dealer permit (off-premises consumption), or his servant, agent or employee to sell, serve, offer to sell, dispense, or give away any alcoholic beverage between the hours of 2:00 a.m. and 7:00 a.m. on any day of the week.

All bars, barrooms, lounges, night clubs, saloons, restaurants, or any other type of business holding a Class A retail dealer permit which permits the consumption of alcoholic beverages on the premises shall be closed for business at 2:00 a.m. each morning and shall remain closed until 7:00 a.m. the same morning, and no persons, other than the owner or his employees, shall be permitted to remain on the premises between 2:00 a.m. and 7:00 a.m. each morning.

WARD 3--Sales Regulations:
No person shall sell or keep for sale the following beverages in the unincorporated area of Ward 3 in the parish: Beverages of low alcoholic content containing more than 3.2% alcohol by weight and not more than 6% alcohol by volume; Beverages containing more than 0.5% alcohol by volume but not more than 3.2% alcohol by weight; Beverages of high alcoholic content containing more than 6% alcohol by volume for consumption on the premises; Beverages of high alcoholic content containing more than 6% alcohol by volume by the package only and not for consumption on the premises.

Location Regulations:
No permit shall be granted for any premises situated within 300 feet or less distance of a public playground or within 500 feet or less distance of a building occupied exclusively as a church or synagogue, public library, school or cemetery, except a school for business education conducted as a business college or school. Certain exceptions apply to bona fide hotels, railroad cars and fraternal organizations.

Possession of Dangerous Weapons on Licensed Premises:
It shall be unlawful for any person to have in his possession a firearm or other instrumentality customarily used or intended for probable use as a dangerous weapon in any premises on which alcoholic beverages are sold and consumed, except for the owner of the business, sheriffs, deputy sheriffs, state police, city police, constables, town or city marshals or persons vested with police power when in the actual discharge of their duties.

It shall be unlawful for any person, firm or corporation holding a retail dealer's permit, or his servant, agent or employee to sell, serve, offer to sell, dispense, or give away any alcoholic beverage between the hours of 2:00 a.m. and 7:00 a.m. on any morning of the week. All bars, bar rooms, lounges, night clubs, saloons, restaurants or any other type of business licensed for consumption of any type of alcoholic beverages on the premises, shall be closed for business at 2:00 a.m. each morning and shall remain closed until 7:00 a.m. the same morning.

Hours of Consumption:

It shall be unlawful for any person to consume any type of alcoholic beverage on the licensed premises or on any parking lot or open or closed space within or contiguous to the licensed premises, between the hours of 2:00 a.m. and 7:00 a.m. on any morning of the week.

Location Regulations:

Beverages of High Alcoholic Content: No permit shall be granted for any premises situated within 300 feet, or less distance of a parish or municipal playground or of a building used exclusively as a regular church or synagogue, public library, or school, except a school for business education conducted as a business college. Parish / Municipal Server Training / Certification Requirements

Beverage Handling Employee Card :

Every employee of an alcoholic beverage permit holder, who may at any time during his or her working hours, sell, serve, or deliver an alcoholic beverage to a consumer or customer on the premises of the alcoholic beverage permit holder, including, but not limited to, waiters, waitresses, barmaids, bartenders, managers, cashiers or floormen shall obtain an alcoholic beverage handling employee card prior to entering into employment on an alcoholic beverage permit holder's premises. Certain exceptions apply. In addition to other qualifications, the person must be of good character and reputation and 18 years of age or older. A beverage handling employee card shall contain the picture and fingerprint of the person to whom it is issued. All alcoholic beverage handling employee cards shall be for a term of one year and shall expire on the 31st day of January, each year. All applicants for renewal may be made within 30 days of the expiration of the old card.
