Hours of Operation - Sunday Sales – District 4 – District 5 - WARD 1 - WARD 3 - WARD 4 - WARD 5 - Location Regulation - Noise Prohibition - Open Containers

Hours of Operation:
It shall be unlawful for any retail dealer or wholesale dealer to open for business or admit or permit any member of the public to enter on or into an establishment or any part thereof between midnight and 7:00 a.m. and between 12:00 a.m. on Sunday until 7:00 a.m. the following Monday. The owner/operator or licensed seller of alcoholic beverages shall remove all patrons and members of the public from the premises by 12:01 a.m. and all doors to said premises shall be locked and closed and the establishment not reopened until 7:00 a.m. the next morning on which sales of alcoholic beverages can be lawfully made. It shall be unlawful for any owner / operator or licensed seller of alcoholic beverages to allow patrons and members of the public to remain in its parking lot for more than 30 minutes after its closing. The owner / operator or licensed seller of alcoholic beverages and his employees or agents may enter the closed premises for the purpose of cleaning, taking stock or other such work reasonably required to be performed on or within the premises while such premises are closed and no business is being transacted. Bottle clubs and private clubs are also required to abide by these restrictions regarding hours of operation / sales & consumption on the premises.

This does not prohibit a grocery store, pharmacy or other similar business possessing a retail or wholesale dealer permit from remaining open for business other than the sale of alcoholic beverages between 12:00 a.m. and 7:00 a.m. and between 12:00 a.m. on Sunday until 7:00 a.m. on the following Monday as long as alcoholic beverages are not allowed to be sold, possessed or consumed on the premises during prohibited times.

WARD 1--Sales Regulations:
The sale of alcoholic beverages containing more than 3.2% alcohol by weight is prohibited in Ward 1.

WARD 3-- Sales Regulations: The sale of alcoholic beverages containing more than 3.2% alcohol be weight is prohibited in Ward 3.

WARD 4-- Sales Regulations:The sale of alcoholic beverages containing more than 0.5% of alcohol by volume is prohibited in Ward 4, including the municipalities of Dubach and Vienna.

WARD 5 Sales Regulations:The sale of alcoholic beverages containing more than 0.5% alcohol by volume but not more than 3.2% alcohol by weight is prohibited in Ward 5, including the municipality of Downsville, but excluding the municipality of Choudrant. The sale of alcoholic beverages containing more than 3.2% alcohol by volume is prohibited in Ward 5, including the municipalities of Downsville and Choudrant. Any person firm or corporation or businesses described shall not be licensed to sell alcoholic beverages containing more than 0.5% alcohol by volume.

Location Regulation:
No permit shall be issued for any premises situated within 500 feet or less distance of a building occupied exclusively as a church or synagogue, public library, public playground or school. Certain exceptions apply for bona fide hotels, railroad cars, and fraternal organizations.

Noise Prohibition:
It shall be unlawful for any owner / operator or licensed seller of alcoholic beverages to play or allow to be played live or recorded music which is so unreasonably intrusive or offensive so as to interfere with the comfortable enjoyment of any other property located within the vicinity of the premises.

Open Containers:
No person holding a retail dealer's permit and no agent, associate, employee, representative, or servant of any such person shall do or permit any of the following acts to be done on or about the licensed premises: Allow any person, patron, customer, agent, associate, or employee to exit the licensed premises in possession of any open container holding an alcoholic beverage when that alcoholic beverage was sold, purchased, served, dispensed, exchanged, acquired or possessed on the licensed premises.


Municipal of Ruston Ordinances

Legal Hours of Operation - Sunday Sales - Bottle Clubs - Location Regulations

Closing Hours:

Between the hours of 12:00 midnight on Saturday and 12:00 noon on Sunday, or between the hours of 12:00 midnight and 6:00 a.m. the following morning, Sunday through Friday, it shall be unlawful for any retail dealer which is a restaurant establishment to sell, offer to sell, dispense or give away any beverages of either low or high alcoholic content within the city, except that the lawful hours shall be extended to 2:00 a.m. on January 1 (New Year's Day) of each calendar year only.

Between the hours of 12:00 midnight on Saturday and 6:00 a.m. on the following Monday, or between the hours of 12:00 midnight and 6:00 a.m. the following morning, Monday through Friday, it shall be unlawful for any retail dealer other than a restaurant establishment to sell, offer to sell, dispense or give away any beverages of either low or high alcoholic content within the city.

If the sale of low or high alcoholic content beverages and/or admission or cover charges to the facility constitutes a majority of the gross receipts of any retail dealer, then at the hours outlined above, the business establishment shall be closed and the dealer shall cause the customers and patrons to leave the premises not later than 12:15 a.m., and shall securely lock all of the entrance doors to the building or other facilities where the high or low alcoholic beverages are sold or dispensed.

Bottle Clubs:

It shall be unlawful for any bottle club to permit or admit any member of the public into such establishment, or part thereof, between the hours of 12:00 midnight on Sunday until 6:00 a.m. the following Monday. The owner/operator of any bottle club shall remove all patrons and members of the public from the premises by 12:01 a.m., and all doors to such premises shall be locked and closed and the establishment shall not be reopened until after 6:00 a.m. the following morning. The owner/operator and his employees or agents may enter the closed premises for the purpose of cleaning, taking stock or other work within the establishment. It shall be unlawful for any bottle club to permit members of the public to remain in the parking lot of such establishment for more than 30 minutes after the closing of such establishment.

Location Regulations:

A permit shall not be granted for any premises situated within 300 feet or less of a public playground or a building used exclusively as a church or synagogue, public library or school, except a school for business education conducted as a business college or school. Certain exceptions apply.
