Sales Generally: The sale of alcoholic beverages is permitted every day except as otherwise provided, restricted or prohibited.

Sales for On-Premises Consumption:
It is prohibited for outlets to sell or dispense beverages with high and/or low alcoholic content for on-the-premises consumption between 2:00 a.m. and 11:00 a.m. on Sundays, between 12:00 midnight and 6:00 a.m. on Mondays, and between 2:00 a.m. and 6:00 a.m. on Tuesdays - Saturdays. The consumption of any alcohol on such premises is prohibited after 12:30 a.m. on Mondays and after 2:30 a.m. on all other days of the week. No person shall be allowed to remain on the premises after 12:30 a.m. Monday and 2:30 a.m. on all the other days of the week except permit holders, paid employees and contractual service workers. Any and all individuals must leave such premises and remain off such premises continuously. The prohibitions contained in this subsection do not apply to bowling alleys or bowling lanes.

Sales for Off-Premises Consumption:
Beverages of High Alcoholic Content: It is prohibited for package houses to sell or dispense beverages with high alcoholic content for off-the-premises consumption between 2:00 a.m. and 11:00 a.m. on Sundays, between 12:00 midnight and 6:00 a.m. on Mondays, and between 2:00 a.m. and 6:00 a.m. on Tuesdays - Saturdays.

Beverages of Low Alcoholic Content: It is prohibited for package houses to sell or dispense beverages with low alcoholic content for off-the-premises consumption between12:00 midnight and 6:00 a.m. on Mondays and between 2:00 a.m. and 6:00 a.m. on Tuesdays - Sundays.

Exception When Holiday Falls On Sunday:
If New Year's Eve (December 31) or the Fourth of July (July 4) falls on Sunday, the Sunday and Monday prohibitions outlined above shall apply, except that the selling or dispensing of beverages with high and/or low alcoholic content for on-the-premises or off-the-premises consumption is only prohibited after 2:00 a.m. on the Monday immediately following the holiday. The consumption of any alcohol on the premises is prohibited after 2:30 a.m. on the Monday immediately following the holiday. No one shall remain on the premises after 2:30 a.m. on the Monday immediately following the holiday, except permit holders, paid employees and contractual service workers.

Re-Opening Hours:
Any outlet where alcoholic beverages are the principal commodities sold or handled shall be allowed to re-open to the public at 6:00 a.m. all days of the week. At no time shall any alcoholic beverage be allowed to be sold, dispensed or consumed outside of the hours prescribed above.

Public Nuisances:
It shall be unlawful for any permittee's establishment, place of business, and/or premises to become a public nuisance and against the public good and welfare of the community

Location Regulations
No permit to sell, serve, and/or dispense alcoholic beverages shall be issued for any establishment located within a distance of 300 feet of any school, public library or public playgrounds except business colleges, business schools, or the University of Louisiana, at Lafayette. No permit to sell alcoholic beverages shall be issued for any establishment located within a distance of 175 feet of any church or synagogue. Certain exceptions apply for restaurants and bona fide hotels.

On-Premises & Off-Premises Consumption Certificate:
Any person including owners and managers, who sells, dispenses, or serves alcoholic beverages in a permitted establishment for on-the-premises consumption must file an application for a certificate of qualification prior to selling, dispensing or serving an alcoholic beverage. A nonrefundable application fee of $30.00 payable to the city-parish consolidated government shall be collected by the director at the time of application. Permit holders shall be exempt from the $30.00 fee. Applicants shall then appear in person at the Criminal Justice Support Services Office, accompanied with a paid application receipt as well as an acceptable pictured ID showing documentary proof of age. At the time of appearance, the applicant shall be photographed and fingerprinted.

Any person, including owners and managers, who sells, dispenses, or serves alcoholic beverages in a permitted establishment for off-the-premises consumption must file an application for a certificate of qualification prior to selling or serving an alcoholic beverage. A nonrefundable application fee of $15.00 payable to the city-parish consolidated government shall be collected by the director at the time of application. Permit holders shall be exempt from the $15.00 fee. Applicants shall then appear in person at the Criminal Justice Support Services office, accompanied with a paid application receipt as well as an acceptable pictured ID showing documentary proof of age. At the time of appearance, the applicant shall be photographed.

In addition to other qualifications, each applicant for a certificate of qualification for on-premises consumption must be of good character and reputation, and 18 years of age or older. In addition to other qualifications, each applicant for a certificate of qualification for off-premises consumption must be 18 years of age or older.

The certificate of qualification to sell, dispense or serve alcoholic beverages shall be carried at all times when the certificate holder sells, serves or dispenses alcoholic beverages. The certificate of qualification is valid for two years from the date of application. The certificate of qualification must be renewed prior to its expiration. The holder of a certificate of qualification issued under this division shall notify the director in writing or in person of any change of employment and/or home address within five working days of any change.

Unincorporated Areas of Parish

General Sales:
The sale of any alcoholic beverages is permitted every day except as otherwise provided, restricted or prohibited. The prohibitions, exceptions and restrictions set out below shall have no application to those days upon which falls New Year's Eve from 6:00 p.m. thereof to 2:00 a.m. of the following day.

Restaurant Endorsement Permit:
The following restrictions shall not be applicable between 11:00 a.m. and 12:00 midnight on Sundays to those persons who are granted an exemption which will allow the serving of alcoholic beverages of low and high alcoholic content between 12:00 noon Sunday and 12:00 midnight Sunday, provided the restaurant facilities are open and in operation during the same period.

Sale of Beverages of High Alcoholic Content Generally:
Except as otherwise provided, the sale of beverages of high alcoholic content between 2:00 a.m. Sunday and 6:00 a.m. on Monday, and between 2:00 a.m. and 6:00 a.m. on Tuesday - Saturday, is prohibited.

Sale of Beverages of Low Alcoholic Content Generally:
Except as otherwise provided, the sale of beverages of low alcoholic content between 2:00 a.m. and 6:00 a.m. on Sunday - Saturday is prohibited.

Sale of Beverages of High Alcoholic Content for Off-Premises Consumption:
It is prohibited for package houses and supermarkets to sell or dispense beverages of high alcoholic content for off-the-premises consumption between 2:00 a.m. and 11:00 a.m. on Sundays, between 12:00 midnight and 6:00 a.m. on Mondays, and between 2:00 a.m. and 6:00 a.m. on Tuesdays - Saturdays.

Sale of Beverages of Low Alcoholic Content for Off-Premises Consumption:
It is prohibited for package houses and supermarkets to sell or dispense beverages of low alcoholic content for off-the-premises consumption between 12:00 midnight and 6:00 a.m. on Mondays and between 2:00 a.m. and 6:00 a.m. on Tuesdays - Sundays.

Consumption of Alcoholic Beverages in any Public Establishment:
The consumption of alcoholic beverages, in any public establishment, between 2:30 a.m. and 6:00 a.m., is prohibited. It shall be unlawful for any house of public entertainment, or the holder of an occupational retail license, or his employees or agents, to permit consumption of alcoholic beverages at their establishment or place of business between the hours of 2:30 a.m. and 6:00 a.m. on any day.

Closing Hours:
Any establishment where alcoholic beverages are the principal commodities sold or handled shall close and remain closed between 2:30 a.m. Sunday and 6:00 a.m. Monday, and between the hours of 2:30 a.m. and 6:00 a.m. on Tuesday - Saturday. This section includes, but is not limited to, the bar or cocktail lounge portion of any hotel and/or motel and/or restaurant.                

Location Regulations--Unincorporated Areas:
Beverages of high alcoholic content: Except as otherwise provided by state law, no permit required by the provisions of this article for beverages of high alcoholic content shall be granted for any business located within 500 feet of a church, synagogue, public library, school or playground.

Beverages of low alcoholic content: Except as otherwise provided by state law, no permit required by the provisions of this article for beverages of low alcoholic content shall be granted for any business located within 300 feet of a public playground or 500 feet of a building used exclusively as a church or synagogue, public library or school, except a school for business education conducted as a business college or school.

Prohibition of Removal of Open Alcoholic Beverage Containers from Premises:
No person, whether patron, customer or employee, shall remove any open alcoholic beverage container of any type from the premises of a permittee in the Downtown District and Simcoe-Surrey Street Corridor, and in the McKinley Street Area, except as provided by ordinance. All permittees of any premises located in these areas shall post a conspicuous notice inside the premises as well as by each public exit stating that it is illegal to remove any open alcoholic beverage container of any type from its premises. The notice sign shall read "CITY-PARISH ORDINANCE PROHIBITS THE REMOVAL OF ANY OPEN ALCOHOLIC BEVERAGE CONTAINER OF ANY TYPE FROM THIS PREMISES."

No person shall engage in the public possession of any open alcoholic beverage container in the Downtown District and Simcoe-Surrey Street Corridor, and in the McKinley Street Area, except as provided by ordinance. Certain exemptions apply for special events and sidewalk cafes in this area.

Unincorporated Areas
Certificate Required:
No person shall dispense or serve any alcoholic beverage in any retail establishment which is licensed for on-the-premises consumption of alcohol without a certificate of qualification issued by the sheriff pursuant to this division. Exemptions: The holder of a permit to sell alcoholic beverages at a particular establishment shall be allowed to dispense or serve alcoholic beverages at that establishment without having a certificate of qualification. If the sale or handling of alcoholic beverages does not constitute the main business of an establishment, the waiters, waitresses, carhops and busboys shall not be required to obtain a certificate of qualification.

In addition to other qualifications, each applicant for a certificate of qualification to dispense or serve alcoholic beverages shall be of good character and reputation and over 18 years of age.

The certificate of qualification shall be carried by the person to whom it is issued and shall be presented to any duly commissioned law enforcement officer on request. All certificates of qualification issued under this division shall expire one year following their issuance, unless suspended or revoked at an earlier date by the sheriff. Such certificates shall be renewed within 30 days prior to their expiration date. The holder of a certificate of qualification issued under this division shall notify the sheriff in writing of any change of employment.

Municipal of Carencro Ordinances

Legal Hours of Sales - Sunday Sales - Exceptions - Location Regulations

Hours of Sales:

The sale of any intoxicating, spirituous, alcoholic, vinous or malt liquors, whether of more or less than six percent of alcohol by volume, is permitted every day except as provided, restricted or prohibited. The prohibitions, exceptions and restrictions shall have no application to those days upon which falls New Year's Eve from 6:00 p.m. thereof to 2:00 a.m. of the following day.

The sale of intoxicating, spirituous, alcoholic, vinous or malt liquors of an alcoholic content of more or less than six percent by volume between the hours of 2:00 a.m. and 6:00 a.m. on Sunday and 12:00 a.m. and 6:00 a.m. Monday, and between the hours of 2:00 a.m. and 6:00 a.m. on Tuesday, Wednesday, Thursday, Friday and Saturday, is prohibited.

Exceptions:

These prohibitions are not applicable between the hours of 6:00 a.m. Sunday and 12:00 a.m. Monday to those persons holding a license to operate a restaurant issued by the city, which licensee shall be permitted to serve alcoholic beverages of high and low alcoholic content between the hours of 6:00 a.m. Sunday and 12:00 a.m. Monday provided the restaurant facilities are open and in operation during the same period.

Motels, hotels and convention facilities shall be permitted to serve alcoholic beverages between the hours of 6:00 a.m. Sunday to 12:00 a.m. Monday to legitimate groups, guests and other private functions, but shall be prohibited from opening bars or lounges to the general public, during the hours specified herein, for the purpose of selling such beverages.

Religious, charitable, fraternal, veterans and other private clubs, organizations and facilities, which are nonprofit and tax-exempt shall be permitted to sell beverages between the hours of 6:00 a.m. Sunday and 12:00 a.m. Monday.

Any establishment where intoxicating, spirituous, alcoholic, vinous or malt liquors, whether of more or less than six percent of alcohol by volume, are the principal commodities sold or handled shall close and remain closed and all non-employees must be removed from the premises continuously between the hours of 2:30 a.m. and 6:00 a.m. on Sunday and 12:30 a.m. and 6:00 a.m. Monday and between the hours of 2:30 a.m. and 6:00 a.m. on Tuesday, Wednesday, Thursday, Friday and Saturday.

The consumption of intoxicating, spirituous, alcoholic, vinous or malt liquors, whether of more or less than six percent of alcohol by volume, in any establishment or on the grounds and/or parking lot of any establishment, provided such liquors were provided either through the sale or gift by the establishment, between the hours of 2:30 a.m. and 6:00 a.m. on Sunday and 12:30 a.m. and 6:00 a.m. Monday and 2:30 a.m. and 6:00 a.m. on Tuesday, Wednesday, Thursday, Friday and Saturday is prohibited.
